. 3/16/98 <br /> <br /> ORIGINAL <br /> RESOLUTION NO. 13296 <br /> <br /> RESOLUTION ESTABLISHING PROCEDURE FOR DISABILITY <br /> RETIREMENT DETERMINATIONS OF EMPLOYEES WHO ARE <br /> LOCAL SAFETY MEMBERS OF THE PUBLIC EMPLOYEES' <br /> RETIREMENT SYSTEM <br /> <br /> WHEREAS, pursuant to Government Code Section 21156, the <br /> determination of incapacity for the performance of duties of Local Safety <br /> Members (as that term is defined in the Public Employees' Retirement Law; Gov. <br /> Code § 20000, et seq; the "Law") is vested in this Council, as the governing body <br /> of the City of Redwood City, a contracting agency under the Law; and <br /> <br /> WHEREAS, pursuant to Resolution No. 9679, adopted August 27, 1984, <br /> this Council delegated to the City Manager the authority to determine such <br /> incapacity, to make applications for disability retirement, and to take all other <br /> appropriate actions with regard to disability retirement and reinstatement of <br /> members under the Law; and <br /> <br /> WHEREAS, pursuant to Section 21156 of the Law, a Local Safety <br /> Member may appeal the determination regarding incapacity; and <br /> <br /> WHEREAS, this Council desires to establish a procedure governing Local <br /> Safety Member disability retirement applications and appeals pertaining thereto; <br /> <br /> NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY <br /> OF REDWOOD CITY, AS FOLLOWS: <br /> <br /> 1.
