Ekblom (hereinafter "Owner") has requested <br /> <br />permission to use an existing retaining wall on the real property <br /> <br />described in Exhibit "A" hereof; and <br /> <br />WHEREAS, it is the intention and desire of this Council to <br /> <br />grant a revocable encroachment permit permitting use of such a <br /> <br />retaining <br /> <br />wall <br /> <br />subject <br /> <br />to <br /> <br />certain <br /> <br />designated <br /> <br />terms <br /> <br />and <br /> <br />conditions; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. That the City Manager is hereby authorized to execute a <br /> <br />revocable <br /> <br />encroachment <br /> <br />permit <br /> <br />to <br /> <br />Owner <br /> <br />which <br /> <br />shall <br /> <br />be <br /> <br />transferrable <br /> <br />or <br /> <br />assignable <br /> <br />to <br /> <br />his <br /> <br />heirs, <br /> <br />executors, <br /> <br />administrators, <br /> <br />assigns, <br /> <br />beneficiaries, <br /> <br />and successors <br /> <br />(of <br /> <br />whatever nature), for the existing retaining wall upon that <br /> <br />certain City-owned real property, more particularly described in <br /> <br />Exhibit "A" of that certain revocable encroachment permit <br /> <br />attached hereto and by this reference incorporated herein, which <br /> <br />permit shall not be effective until such time as the Owner <br /> <br />executes an acceptance of its terms and conditions. <br /> <br />9749 <br />
