0 R I G I N A L 6/2/97 <br /> <br /> RESOLUTION NO. 13096 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF AGREEMENT GRANTING ENCROACHMENT AGREEMENT <br /> FOR THE INSTALLATION OF FIBER OPTIC NETWORK <br /> FACILITIES WITHIN THE PUBLIC RIGHT-OF-WAY <br /> <br /> (BROOKS FIBER COMMUNICATIONS OF SAN JOSE, INC.) <br /> <br /> WHEREAS, Brooks Fiber Communications of San Jose, Inc., a Nevada <br />Corporation, wishes to install and maintain fiber optic network facilities within the <br />public right of way within the limits of the City of Redwood City; and <br /> <br /> WHEREAS, under California law, the City of Redwood City may regulate <br />the location and the manner of construction, installation, and maintenance of <br />network facilities in the public right-of-way within the limits of the City of <br />Redwood City; and <br /> <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, as follows: <br /> <br /> That certain permit agreement entitled "Encroachment Agreement <br />Between the City of Redwood City and Brooks Fiber Communications of San <br />Jose, Inc.," (form dated 516197) by and between the City of Redwood City, a <br />municipal corporation of the State of California and Brooks Fiber <br />Communications of San Jose, Inc., granting authorization to Brooks Fiber <br />Communications of San Jose, Inc., to install, maintain, and repair fiber optic <br />network facilities within the public right-of-way, a copy of which agreement is on <br />file in the office of the City Clerk, to which copy reference is hereby made for the <br /> <br /> <br />
