0 R I G I N A L 3/24/97 <br /> RESOLUTION NO. 13035 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> ACKNOWLEDGMENT OF RECEIPT AND RELEASE OF ALL <br /> CLAIMS RELATING TO WATER SALES CONTRACT WITH THE <br /> CITY AND COUNTY OF SAN FRANCISCO <br /> <br /> WHEREAS, pursuant to Resolution No. 9579 adopted May 14, 1984, the <br />City of Redwood City entered into a water supply contract (the '~Nater Supply <br />Contract") dated August 16, 1984 with the City and County of San Francisco <br />("San Francisco"); and <br /> <br /> WHEREAS, the Water Supply Contract incorporates by reference that <br />certain settlement agreement and master water sales contract (the "Master <br />Agreement"), setting forth the terms and conditions under which San Francisco <br />continues to furnish water for domestic and other municipal purposes to the City <br />of Redwood City as one of the "Suburban Pumhasers" under the Master <br />Agreement; and <br /> <br /> WHEREAS, the Master Agreement provides that property taxes paid by <br />San Francisco on property located within the Counties of San Mateo, Alameda <br />and Santa Clara (the "Counties") are an expense of San Francisco's wholesale <br />water system, a portion of which is allocated to the City of Redwood City in the <br />water rates charged to this City by San Francisco; and <br /> <br /> WHEREAS, in 1987 San Francisco commenced lawsuits against San <br />Mateo and Alameda Counties, in which San Francisco contended that each <br />County had not valued San Francisco's property in compliance with Article XIIIA <br /> <br /> Res~-154 1 <br /> G:~sharedVedwood',council <br /> DES:djk <br /> 03/17/97 <br /> <br /> <br />
