ORIGINAL <br /> RESOLUTION NO. 12947 10/28/96 <br /> <br /> RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> APPROVING AND AUTHORIZING EXECUTION OF THE FIFTH <br /> AMENDMENT OF THE DISPOSITION AND DEVELOPMENT AGREEMENT <br /> FOR THE MEZES PLAZA PROJECT <br /> <br /> WHEREAS, the Redevelopment Agency of the City of Redwood city (the "Agency") and <br />Mezes Group, Inc., a Califomia Corporation (the "Developer") have negotiated a Fifth <br />Amendment (the "Amendment") to that certain agreement entitled "Disposition and <br />Development Agreement for the Mezes Plaza Project," as amended (the "DDA"); and <br /> <br /> WHEREAS, the City of Redwood City (the "City") is a party to the DDA to the limited <br />extent that the City is to contribute to the Project an easement eight (8') feet in width for <br />underground parking under the portion of Broadway that abuts the Project Site; and <br /> <br />NOW, THEREFORE, THIS COUNCIL DOES HEREBY RESOLVE AS FOLLOWS: <br />This Council hereby approves and authorizes the Mayor and the City Clerk to execute and <br />to attest, respectively, that certain Amendment entitled "Fifth Amendment of Disposition and <br />Development Agreement for the Mezes Plaza Project" on behalf of the City of Redwood City, <br />such execution to bind the City to the limited extent set forth in the DDA and the Amendment <br />thereto. <br /> <br /> <br />
