Code § 273$3. <br />IMPROVEMENT AGREEMENT <br />612.1eBe,,rsou Avenue l <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this _ day of _ <br />2 2019 ("Effective Date") by and between by and between Habitat for Humanity <br />Greate San Francisco, a California nonprofit public benefit corporation ("Developer"), and the <br />CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City") with <br />reference to the following facts: <br />RECITALS <br />A . Developer is the current fee owner of that certain real property consisting of <br />approximately 0. 11 acres located within the City of Redwood City, County of San Mateo; State of <br />California, described in Exhibit A attached hereto and incorporated herein by reference (the "Property"). <br />B. On May 2204, 2017, the City Council of the City of Redwood City adopted, among other <br />approvals; Resolution No. 15588, approving the Vesting Tentative Map for the 612 Jefferson Project <br />"Project"), prepared by BKF Engineers and dated October 110', 2016 ("Tentative Map"), subject to <br />certain conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the Final Map ("Final Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled Offsite <br />Improvement Plans for 612 Jefferson Avenue, prepared by BKF Engineers and dated M n, , 20-L11 <br />(the "Tmprovement Plans"), which, in addition to other improvements, provide for certain on-site public <br />improvements consisting of street and street light improvements, storm drain systems, domestic water <br />systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br />F.
