02/07/2011 <br /> ORIGINAL <br /> RESOLUTION NO. 15090 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY SETTING ASIDE THE FOLLOWING FINGER <br /> AVENUE PROJECT APPROVALS RELATED TO THE INITIAL <br /> STUDY /MITIGATED NEGATIVE DECLARATION, PLANNED <br /> DEVELOPMENT PERMIT, AND VESTING TENTATIVE MAP: <br /> MINUTE ORDER NOS. 09 -167, 09 -168, 09 -232, 09 -233 <br /> WHEREAS, on July 29, 2010, a Stipulated Judgment was entered and <br /> issued by the Honorable Marie S. Weiner, Judge of the Superior Court, County of <br /> San Mateo in the matter of Friends of Cordilleras Creek and Finger Avenue Pride <br /> Committee (collectively "Friends "), plaintiffs v. City of Redwood City and City <br /> Council of the City of Redwood City, defendants, Case No. CIV 489446. <br /> WHEREAS, the Stipulated Judgment made the Finger Avenue Settlement <br /> Agreement the Order of the Court requiring the City of Redwood City to set aside <br /> certain approvals with respect to the 50, 80 and 88 Finger Avenue Project <br /> (Finger Avenue Project). <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF REDWOOD CITY AS FOLLOWS: <br /> Section 1. Set Aside of Minute Order Actions <br /> 1. Minute Order No. 09 -167, which denied the Friends' appeal and upheld <br /> the Planning Commission adoption of the Initial Study /Mitigated <br /> Negative Declaration for the Finger Avenue Project, is hereby set <br /> aside. <br /> 2. Minute Order No. 09 -168, which directed staff to return to the City <br /> Council at the appropriate time with the modifications discussed by the <br /> City Council to the Planned Development Permit (PD) and Vesting <br /> Tentative Map (VTM), and whereby City Council retained jurisdiction of <br /> the PD and VTM, is hereby set aside. <br /> 3. Minute Order No. 09 -232, which upheld the applicant developer's <br /> appeal and approved the PD, is hereby set aside. <br /> 4. Minute Order No. 09 -233, which upheld the applicant developer's <br /> appeal and approved the VTM, is hereby set aside. <br /> 5. The Stipulated Judgment mandates that the City rescind all approvals <br /> for the Finger Avenue Project, including the approval of the Initial <br /> ATTY /RESO /RESO.2091 Reso #15090 <br /> 012611 MUFF # 603 <br />
