10/24/2011 <br /> ORIGINAL <br /> RESOLUTION NO. 15150 <br /> RESOLUTION OF NOTICE OF INTENT TO VACATE PORTIONS OF <br /> WALNUT STREET IN THE CITY OF REDWOOD CITY PURSUANT TO <br /> PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS <br /> CODE OF THE STATE OF CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3(commencing at Section 8300) <br /> of Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby declares its intention to vacate an excess portion <br /> of City right-of-way within Walnut Street located as shown on Parcel Map No. 2007-02 <br /> in Book 77 of Parcel Maps, at Pages 85 and 86, in the office of the Recorder for the <br /> County of San Mateo; is attached hereto as Exhibit 1 and Exhibit 2; and <br /> WHEREAS, because there are in-place utilities that are in use, vacation of <br /> Walnut Street is subject to a reservation and exception from vacation of an easement <br /> and right to construct, maintain, operate, replace, remove, or renew public utility <br /> facilities, unless the City Council determines the public convenience and necessity <br /> require otherwise; and <br /> WHEREAS, attached to Exhibit 3(Public Hearing Notice.) is a map or plan and <br /> legal description that shows the area intended to be vacated; and <br /> WHEREAS, pursuant to said provisions of the California Streets and Highways <br /> Code, notice of intention to vacate the herein described portion of the Walnut Street <br /> right of way shall be published and posted in substantially the form attached hereto as <br /> Exhibit 3; and <br /> WHEREAS, a noticed public hearing on the question of vacating portions of <br /> Walnut Street, as described below, shall be held and evidence thereon received by the <br /> City Council on November 14, 2011; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> 1.
