12/12/2011 <br /> ORIGINAL <br /> � RESOLUTION NO. 15157 <br /> RESOLUTION AUTHORIZING CITY TO VACATE PORTIONS OF <br /> WALNUT STREET IN THE CITY OF REDWOOD CITY PURSUANT TO <br /> PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS <br /> CODE OF THE STATE OF CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3(commencing at Section 8300) <br /> of Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby vacates portions City right-of-way within Walnut <br /> Street located in Parcel Map No. 2007-02 in Book 77 of Parcel Maps, at Pages 85 and <br /> 86, in the office of the Recorder for the County of San Mateo, is attached hereto as <br /> Exhibit 1 and Exhibit 2; and � <br /> WHEREAS, because there are in-place utilities that are in use, vacation of <br /> Walnut Street is subject to a reservation and exception from vacation of an easement <br /> and right to construct, maintain, operate, replace, remove, or renew public utility <br /> facilities, unless the City Council determines the public convenience and necessity <br /> require otherwise; and <br /> WHEREAS, on October 24, 2011, the City Council adopted a resolution of <br /> intention to portions of Walnut Street, and setting a public hearing for December 12, <br /> 2011; and <br /> WHEREAS, pursuant to said provisions of the California Streets and Highways <br /> Code, notice of intention to vacate the herein described portion of Parcel Map No. 2007- <br /> 02 in Book 77 of Parcel Maps, at Pages 85 and 86, was published and posted in <br /> substantially the form attached hereto as Exhibit 3(public hearing notice); and <br /> WHEREAS, the City also sent utilities notice of its intention to vacate in <br /> substantially the form attached hereto as Exhibit 4(Notice to Utilities) as well as notice <br /> to property owners within 300 feet; and . <br /> , WHEREAS, City held a public hearing on December 12, 2011 to hear evidence <br /> offered by interested persons and to determine from all of the evidence submitted <br /> whether the described portions of the Walnut Street right-of-way is unnecessary for <br /> present or prospective public use. <br /> ATTY/RESO. 2173/ AUTHORIZING THE CITY TO VACATE PORTIONS OF WALNUT ST. � RESO. # 15157 <br /> >>> � MUFF#606 <br /> t <br />
