06/24/2013 <br /> ORIGINAL <br /> RESOLUTION NO. 15272 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY (1) APPROVING, AND AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE, THE AMENDED AND RESTATED AGREEMENT BETWEEN <br /> CITIES OF REDWOOD CITY AND SAN CARLOS FOR FIRE & <br /> EMERGENCY SERVICES, AND AUTHORIZING THE CITY MANAGER <br /> TO NEGOTIATE AND EXECUTE AN ANNUAL UPDATED EXHIBIT C <br /> TO THE AMENDED AND RESTATED AGREEMENT, AND <br /> (2) APPROVING, AND AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE, THE AGREEMENT FOR TRANSFER OF FIRE SERVICES <br /> PERSONNEL FROM THE CITY OF SAN CARLOS TO CITY OF <br /> REDWOOD CITY <br /> WHEREAS, on July 7, 2011, the City of Redwood City ("Redwood City") entered <br /> into that certain Agreement between the Cities of Redwood City and San Carlos ("San <br /> Carlos") for Fire & Emergency Services ("Services Agreement"); and <br /> WHEREAS, the Services Agreement was modified by that certain First Amendment <br /> to Agreement between Redwood City and San Carlos for Fire and Emergency Services <br /> dated October 19, 2011 ("First Amendment") to revise Sections 2 and 5; and <br /> WHEREAS, the Services Agreement was further modified by that certain Second <br /> Amendment to Agreement between Redwood City and San Carlos for Fire and <br /> Emergency Services dated August 13, 2012 ("Second Amendment") to allow the two <br /> Cities to provide personnel to augment the staffing of the other City on a critical needs <br /> basis; and <br /> WHEREAS, Redwood City and San Carlos have desire to enter into that certain <br /> Amended and Restated Agreement between Cities of Redwood City and San Carlos for <br /> Fire & Emergency Services, attached hereto as Exhibit A ("Amended and Restated <br /> Services Agreement") and that certain Agreement for Transfer of Fire Services <br /> Personnel from the City of San Carlos to City of Redwood City, attached hereto as <br /> Exhibit B ("Transfer Agreement"). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES HEREBY RESOLVE AS FOLLOWS: <br /> 1. The City Council hereby approves the Amended and Restated Agreement <br /> between Cities of Redwood City and San Carlos for Fire & Emergency Services, <br /> attached hereto as Exhibit A, and authorizes and directs the City Manager to execute <br /> the Amended and Restated Services Agreement, subject to any minor, clarifying and <br /> conforming changes approved by the City Attorney. The City Council further authorizes <br /> the City Manager to take all actions necessary to carry out the Amended and Restated <br /> Services Agreement, including execution of the Fire Station Lease Agreement attached <br /> ATTY/RES0.2874/APPROVING AMENDED AND RESTATED RESO.#15272 <br /> FIRE SERVICES AGREEMENT AND TRANSFER AGREEMENT MUFF#304 <br /> REV:06-18-13 VR <br /> Page 1 of 2 <br />
