10/26/2015 <br /> ORIGINAL <br /> RESOLUTION NO. 15452 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> VACATING A PORTION OF THE WINSLOW STREET RIGHT OF WAY IN <br /> THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, <br /> CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF <br /> CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of <br /> Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby vacates a portion of the public right of way <br /> described in grant deed recorded in Book 453 at page 371 in the official records of San <br /> Mateo County on February 6, 1930; and that public right of way to be vacated is attached <br /> hereto as Exhibit A and Exhibit B; and <br /> WHEREAS, because there are no in-place utilities that are in use, vacation of the <br /> right of way is not subject to any reservations or exceptions; and <br /> WHEREAS, the right of way has been impassable for vehicular travel for five <br /> consecutive years immediately preceding the proposed vacation. <br /> WHEREAS, no public money was expended for maintenance on the street or <br /> highway for five consecutive years immediately preceding the proposed vacation. <br /> WHEREAS, Pursuant to Section 8331 of the Streets and Highways Code of the <br /> State of California allows a city to summarily vacate a public service easement if "for a <br /> period of five consecutive years, the portion of street or highway has been impassable for <br /> vehicular travel, and no public money was expended for maintenance on the portion of <br /> street of highway during such period.". <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> 1. The recitals set forth above are true and correct, and are hereby <br /> incorporated herein by this reference as if fully set forth in their entirety. <br /> 2. Pursuant to Section 8331 of the Streets and Highways Code, the right of <br /> way to be vacated is not used for public purposes. <br /> 3.
