10/26/2015 ORIGINAL RESOLUTION NO. 15453 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD VACATING A PUBLIC UTILITY EASEMENT ON 899 BROADWAY IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of Division 9 of the California Streets and Highways Code, the City Council of the City of Redwood City ("City Council"), hereby vacates the public utility easement on 899 Broadway located as shown on the Subdivision Map "Redwood Industrial Tract No. 1" in Book 27 of Maps, at Pages 39 and 40, in the office of the Recorder for the County of San Mateo; and that public utility easement to be vacated is attached hereto as Exhibit A and Exhibit B; and WHEREAS, because there are no in-place utilities that are in use, vacation of the public utility easement is not subject to any reservations or exceptions; and WHEREAS, the easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation; and WHEREAS, the date of dedication or acquisition is less than five years, and more than one year, immediately preceding the proposed vacation, and the easement was not used continuously since that date; and WHEREAS, the easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation; and WHEREAS, the easement has been determined to be excess by the City, and there are no other public facilities located within the easement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety.
