10/26/2015 <br /> ORIGINAL <br /> RESOLUTION NO. 15453 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> VACATING A PUBLIC UTILITY EASEMENT ON 899 BROADWAY IN <br /> THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, <br /> CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF <br /> CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of <br /> Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby vacates the public utility easement on 899 <br /> Broadway located as shown on the Subdivision Map "Redwood Industrial Tract No. 1" in <br /> Book 27 of Maps, at Pages 39 and 40, in the office of the Recorder for the County of San <br /> Mateo; and that public utility easement to be vacated is attached hereto as Exhibit A and <br /> Exhibit B; and <br /> WHEREAS, because there are no in-place utilities that are in use, vacation of the <br /> public utility easement is not subject to any reservations or exceptions; and <br /> WHEREAS, the easement has not been used for the purpose for which it was <br /> dedicated or acquired for five consecutive years immediately preceding the proposed <br /> vacation; and <br /> WHEREAS, the date of dedication or acquisition is less than five years, and more <br /> than one year, immediately preceding the proposed vacation, and the easement was not <br /> used continuously since that date; and <br /> WHEREAS, the easement has not been used for the purpose for which it was <br /> dedicated or acquired for five consecutive years immediately preceding the proposed <br /> vacation; and <br /> WHEREAS, the easement has been determined to be excess by the City, and <br /> there are no other public facilities located within the easement. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> 1.
