03/28/2016 RESOLUTION NO. 15481 i RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY ESTABLISHING SOLID WASTE COLLECTION RATES WHEREAS , pursuant to agreement with the South Bayside Waste Management Authority (SBWMA), a rate analysis has been conducted regarding solid waste collection rates in the City of Redwood City; and WHEREAS, upon the recommendation of said Authority, of which this City is a member agency, revisions to the rates of charge for said purposes have been proposed ; and WHEREAS, pursuant to the provisions of Section 14 . 31 of the Municipal Code of the City of Redwood City, schedules of charges for such purposes shall be established by resolution of this Council ; and WHEREAS, the City Council's action is not a "project" pursuant to CEQA Guidelines section 15378(b)(4) because the City is setting maximum rates for solid waste collection to be charged by Recology San Mateo County which are intended to fund on-going solid waste collection services, and as such , the action involves a funding mechanism or fiscal activity within the meaning of the CEQA Guidelines; and WHEREAS , notices were sent as required by Government Code Section 53755 , a hearing was held in accordance with the requirements of Article XIII D , Section 6 of the California Constitution (Proposition 218) , no majority protest exists , and the proposed rate increase complies with the limitations for use in Article XIII D, Section 6(b) . NOW, THEREFORE BE R RESOLVED that the Council of the City of Redwood City hereby approves, as follows: 1 . The schedule of charges for solid waste collection services in the C ity of Redwood City is hereby established as set forth i n Exhibit "A," attached hereto and by this reference Incorporated herein . 2 .
