09/12/2016 <br /> RESOLUTION NO. 15523 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY AMENDING PORTIONS OF THE DOWNTOWN <br /> PRECISE PLAN TO PROMOTE ACTIVE GROUND FLOOR USES IN <br /> DOWNTOWN <br /> WHEREAS , this proposed DTPP Amendment is comprised of the various parts: <br /> a) Modify the Use Regulations Map (2.2) to require active ground floor uses <br /> on Main Street between Broadway and Middlefield ; and <br /> b) Modify the Use Regulations Chart (2 .2) to expand where active uses are <br /> permitted and reformat the table to make the regulations more user friendly; <br /> and <br /> c) Modify the Historic Resources Preservation Chart (2 . 1 ) to remove reference <br /> to the Use Concessions Provisions for Historic Buildings; and <br /> d) Remove all references to the Use Concessions Provision for Historic <br /> Buildings (2 . 1 .2, 2 .2 .2 , A1 .2 . 1 .A) ; and <br /> e) Revise the Nonconforming Section (2 . 0 . 1 ) to establish a 3-month timeframe <br /> to continue ceased nonconforming uses; and <br /> f) Develop requirements for inactive uses to locate on the ground floor (2.2. 1 ) <br /> to be used when processing Use Permits; and <br /> g) Relocate Permitted Use Groups (2 .2 .3) to the Use Regulations Chart (2 .2) <br /> to make the regulations more user friendly; and <br /> h) Relocate Maximum Establishment Lengths from Use Regulations Chart <br /> (2 .2) to guidelines (2 .2 .4) ; and <br /> i) Remove reference to eliminated Use Groups in regulations governing <br /> permitted Private Frontage Types (2 . 8 .4) . <br /> WHEREAS, on March 28 , 2016 , the City Council held a public hearing to discuss <br /> whether to initiate a DTPP Amendment to require active ground floor uses on Main Street, <br /> between Broadway and Middlefield , based on concerns raised by the Downtown <br /> Business Group and residents. The Council supported initiating the amendment and <br /> asked that staff address non-conforming uses and incentivizing retail uses Downtown ; <br /> and <br /> WHEREAS , on August 16 , 2016 , the Planning Commission held a public hearing <br /> to discuss the proposed DTPP amendments to activate ground floor uses Downtown . <br /> The Commission was supportive of the proposal with modifications : ( 1 ) General Retail be <br /> allowed in the Downtown General DTPP district through approval of a use permit; and (2) <br /> nonconforming uses cannot be re-established after three-months of ceased operations. <br /> The Commission recommended that the City Council adopt the amendments upon finding <br /> Page 1. of 14 <br /> ATTY/RES0.0082/CC RESO DTPP AMENDMENT TO PRESERVE AND EXPAND ACTIVE GROUND FLOOR USES RESO.
