03/26/2018 <br />RESOLUTION NO. 15651 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING AND AUTHORIZING THE CITY MANAGER TO <br />EXECUTE AN AMENDED AND RESTATED FRANCHISE AGREEMENT <br />BETWEEN THE CITY AND RECOLOGY SAN MATEO COUNTY FOR <br />RECYCLABLE MATERIALS, ORGANIC MATERIALS AND SOLID <br />WASTE COLLECTION SERVICES <br />WHEREAS, the State of California, through the California Integrated Waste <br />Management Act of 1989, codified at Public Resources Code Section 40000, et seq. (the <br />"Act"), found and declared that the amount of solid waste generated in California, coupled <br />with diminishing landfill space and potential adverse environmental impacts from landfill <br />disposal, has created a need for state and local agencies to enact and implement an <br />aggressive integrated waste management program; and <br />WHEREAS, the Act directs the responsible State agency and all local agencies to <br />maximize the use of feasible source reduction, recycling and composting options in order <br />to reduce the amount of solid waste that must be disposed in landfills; and <br />WHEREAS, the South Bayside Waste Management Authority ("SBWMA") is a joint <br />powers authority between the cities of Belmont, Burlingame, East Palo Alto, Foster City, <br />Menlo Park, Redwood City, San Carlos and San Mateo; the towns of Atherton and <br />Hillsborough; the West Bay Sanitary District; and the County of San Mateo ("Member <br />Agencies"); and <br />WHEREAS, on August 24, 2009, the Council adopted Resolution No. 14965 <br />approving the Franchise Agreement for Collection Services of Recyclable Materials, <br />Organic Materials, and Solid Waste with Recology San Mateo County ("Franchise <br />Agreement"); and <br />WHEREAS, on May 24, 2010, the Council adopted Resolution No. 15021 <br />approving a Revised Franchise Agreement for Collection Services of Recyclable <br />Materials, Organic Materials and Solid Waste with Recology of San Mateo County in <br />order to reflect the City of Redwood City's specific procedures for billing solid waste <br />customers and the obligations of the City and of Recology San Mateo County pursuant <br />to those procedures; and <br />WHEREAS, on November 4, 2013, the Council adopted Resolution No. 15303, <br />approving Amendment No. 1 to the Franchise Agreement; and <br />WHEREAS, the Franchise Agreement expires on December 31, 2020; however, <br />Section 3.03 of the agreement allows for its extension, stating: "During calendar year <br />2017, the Parties shall meet and confer on the possible extension of the Term;" and <br />WHEREAS, SBWMA and Recology negotiated a Model Amended and Restated <br />Franchise Agreement that was intended to serve as a model agreement for each <br />Member Agency to use as a basis for its negotiations with Recology San Mateo County; <br />and <br />ATTY/RES0.0021/CC RESO ADOPTING AMENDED & RESTATED FRANCHISE AGREEMENT RESOLUTION NO. 15651 <br />REV: 03-20-18 MI MUFF NO. 803 <br />Page 1 of 2 <br />
