0 R I G I ?l A L <br />RESOLUTION NO. 13867 <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br />OF AGREEMENT GRANTING ENCROACHMENT AGREEMENT <br />FOR THE INSTALLATION OF FIBER OPTIC NETWORK <br />FACILITIES WITHIN THE PUBLIC RIGHT -OF -WAY <br />(WILLIAMS COMMUNICATIONS, INC.) <br />4/10/00 <br />WHEREAS, Williams Communications, Inc., dba VYVX, Inc., a Delaware <br />Corporation ( "Williams "), wishes to install and maintain fiber optic network <br />facilities within the public right of way within the limits of the City of Redwood <br />City; and <br />WHEREAS, under California law, the City of Redwood City may regulate <br />the location and the manner of construction, installation, and maintenance of <br />network facilities in the public right -of -way within the limits of the City of Redwood <br />City; <br />NOW, THEREFORE; <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, as follows: <br />That certain permit agreement entitled "Encroachment Agreement <br />between the City of Redwood City and Williams Communications, Inc., dba <br />VYVX, Inc., for the Construction, Installation, and Maintenance of Fiber Optic <br />Network Facilities Cables and Related Facilities Within the Public Right -of- way ", <br />by and between the City of Redwood City, a municipal corporation of the State of <br />California and Williams granting authorization to Williams to install, maintain, and <br />Reso -850 1 <br />F:sh /n alcouncil /reso <br />FXS:djk <br />03/23/00 <br />
