0 R I �, I ii A L 1122101 <br />RESOLUTION NO. 14124 <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br />OF THIRD SUPPLEMENTAL AGREEMENT TO AGREEMENT <br />WITH FAIR OAKS SEWER MAINTENANCE DISTRICT, COUNTY <br />OF SAN MATEO, CONSENTING TO ANNEXATION OF CERTAIN <br />TERRITORY TO SAID DISTRICT <br />WHEREAS, The City of Redwood City ( "City ") and the Fair Oaks Sewer <br />Maintenance District ( "District ") entered into an agreement dated August 27, <br />1985 entitled, "Agreement — Sanitary Sewerage Capacity Rights and Services" <br />( "Basic Agreement "), pursuant to which the City provides sanitary sewerage <br />transmission, treatment and disposal services for sewage emanating from <br />District's territory; and <br />WHEREAS, pursuant to paragraph nine of the Basic Agreement, services <br />furnished, and Capacity Rights reserved and conveyed to the District are <br />expressly limited to sewage emanating from property situated within the service <br />area of District described in Exhibit "C" of the Basic Agreement; and <br />WHEREAS, an owner of land outside the District's existing boundaries <br />has applied to District for annexation of said land thereto, and District, in turn, <br />has requested this Council to consent thereto; and <br />WHEREAS, paragraph eighteen of the Basic Agreement provides that <br />said Agreement may from time to time be revised, altered, amended or <br />supplemented by written agreement; and <br />Reso -1068 <br />F:\s h a red \red wood \cou n c1I <br />DES:djk <br />01/10/01 <br />
