2/11/02 <br />O R I G I N A L <br />RESOLUTION NO. 14415 <br />RESOLUTION VACATING A PORTION OF A 20 FOOT WIDE <br />UNDERGROUND PUBLIC UTILITY EASEMENT AT 3636 & 3642 <br />HAVEN AVENUE (LOT NO. 1, PARCEL MAP 2001 -3) IN THE CITY <br />OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, <br />CHAPTER 4, ARTICLE 1, (SUBSECTION 8333(a)), CALIFORNIA <br />STREETS AND HIGHWAYS CODE OF THE STATE OF <br />CALIFORNIA <br />WHEREAS, The owner of 3636 & 3642 Haven Avenue (Lot No. 1, Parcel <br />Map 3001 -3), Carrera PRB Company, a limited partnership, has requested that <br />the City terminate the public right on the properties for the purpose of installing <br />and maintaining public utilities, and <br />WHEREAS, The 20 foot wide underground public utility easement <br />proposed to be vacated is more particularly described in Exhibit "A" and depicted <br />in Exhibit "B" hereof, which Exhibits are attached hereto and by this reference <br />incorporated herein, and <br />WHEREAS, Section 8333(a) of the Streets and Highways Code of the <br />State of California allows a City to summarily vacate a public service easement if <br />the easement "has not been used for the purpose for which it was dedicated or <br />acquired for five consecutive years immediately preceding the proposed <br />vacation," and <br />WHEREAS, The City and other utility companies do not have any utilities <br />in this 20 -foot easement, nor have any interest in preserving the easement for <br />future public use. <br />F:ATTY/RESO /Reso.1276 <br />020102 <br />
