<br />09/08/2008 <br /> <br />ORIGINAL <br /> <br />RESOLUTION NO. 14895 <br /> <br />RESOLUTION APPROVING AMENDMENT NO. 5 TO THE <br />SANITARY SEWERAGE TREATMENT CAPACITY RIGHTS AND <br />SERVICES (TOWN OF WOODSIDE) AGREEMENT <br /> <br />WHEREAS, on or about May 7, 1997, by Resolution No. 13084, the Town of <br />Woodside entered into an Agreement with the City of Redwood City ("City") to use <br />Redwood City's sewer capacity for the development of their Town Center; and <br /> <br />WHEREAS, on or about June 18, 2002, by Resolution No. 14448, Amendment <br />No.1 was executed, which added two properties to said Agreement; and <br /> <br />WHEREAS, on or about May 10, 2004, by Resolution No. 14581, Amendment <br />NO.2 was executed, which added another property to said Agreement; and <br /> <br />WHEREAS, on or about June 7, 2004, by Resolution No. 14589, Amendment <br />NO.3 was executed, which added another property to said Agreement; and <br /> <br />WHEREAS, on or about February 12, 2007, by Resolution No. 14764, <br />Amendment NO.4 was executed, which added another property to said Agreement; and <br /> <br />WHEREAS, the Agreement previously limited the service area to the Downtown <br />Area of the Town of Woodside and the area from Palm Circle Road to Godetia Drive, <br />and from Canada Road to Glencrag Way; and <br /> <br />WHEREAS, the Town of Woodside amended the Town's Sewer Service <br />Allocation regulations on April 24, 2007, to include nine parcels contiguous to the Fair <br />Oaks Sewer Maintenance District Service Area; and <br /> <br />WHEREAS, the Town of Woodside, the County of San Mateo, and the City have <br />developed a fifth amendment to the Agreement in order to provide the framework by <br />which the nine newly designated parcels in the Town of Woodside may be provided <br />public sewer service in the future, should the failure of onsite sewage disposal systems <br />necessitate connection to the sewer system in order to protect the public health; and <br /> <br />WHEREAS, the nine parcels will connect to the Fair Oaks Sewer Maintenance <br />district's facility in the future and at the time of connection, owners shall pay the City for <br />additional treatment capacity, as well as the sewer facilities fee, and the metered <br />service charge for sewage transmission and treatment. <br />A TTY/RESO/RESO.1855 14895 <br />082608 MUFF # 304 <br />
