09/14/2009 <br />ORIGINAL <br />RESOLUTION NO. 14968 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING AN IDENTITY THEFT PREVENTION PROGRAM <br />PURSUANT TO FEDERAL RED FLAG RULES <br />WHEREAS, the Fair and Accurate Credit Transactions Act of 2003 empowered <br />the Federal Trade Commission (FTC) to enact regulations requiring banks and creditors <br />to establish anti - identity theft programs, referred to as "Red Flag Rule"; and <br />WHEREAS, as part of the requirements imposed by the FTC, municipal utilities <br />are considered creditors, and <br />WHEREAS, the City of Redwood City is identified as a municipal utility by the <br />Federal Trade Commission (FTC); and <br />WHEREAS, as a creditor under the FTC's Red Flag Rule, the City is required to <br />establish an Identity Theft Prevention Program by November 1, 2009; and <br />WHEREAS, the FTC requires that the City Council approve a written policy and <br />procedures for identifying red flags associated with identity theft; and <br />WHEREAS, the Identity Theft Prevention Program — Red Flag Rule policy of the <br />Revenue Services Division of the Finance Department of the City of Redwood City <br />meets the requirements set forth by the FTC. <br />NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY, AS FOLLOWS: <br />The Identity Theft Prevention Program — Red Flag Rules is approved and is <br />attached hereto as Exhibit "A ". <br />ATTY /RESO /RESO.1943 14968 <br />090109 MUFF # 205 <br />
