<br />CGM:djg-c 10/22/81 <br /> <br />OCT 2 6 1981 <br /> <br />---------- <br /> <br />RES 0 L UTI 0 N <br /> <br />~ Q. 8 98 ;) <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OR\G\NJ\l <br />OF AGREEMENT BETWEEN CITY OF REDWOOD CITY, THE <br />AMERICAN INSURANCE COMPANY, AND MC CARTHY AND <br />SPIESMAN RELATING TO REDWOOD SHORES PARKWAY - <br />PHASE A IMPROVEMENT PROJECT <br /> <br />WHEREAS, the City of Redwood City and Conco-BPA Enterprises <br /> <br />entered into an agreement, dated June 27, 1980, for the construction <br /> <br />of Redwood Shores Parkway -Phase; and <br /> <br />WHEREAS, Conco-BPA Enterprises has defaulted on its obligations <br /> <br />that it contracted to perform pursuant to the abovereferenced <br /> <br />agreement and the surety for Conco-BPA Enterprises, The American <br /> <br />Insurance Company, has informed the City that it is ready to proceed <br /> <br />to complete all of the contractual obligations of Conco-BPA <br /> <br />Enterprises; and <br /> <br />WHEREAS, The American Insurance Company has selected Mc Carthy <br /> <br />and Spiesman to complete the construction obligations; and <br /> <br />WHEREAS, this Council desires to enter into an agreement <br /> <br />for the completion of the abovereferenced public works project; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />That certain agreement entitled "Agreement for Completion <br /> <br />of Redwood Shores Parkway - Phase A" by and between the City of <br /> <br />Redwood City, The American Insurance Company, and Mc Carthy and <br /> <br />Spiesman, a copy of which agreement is on file in the office of <br /> <br />the City Clerk for full particulars thereof, is hereby approved <br /> <br />and the City Manager is hereby authorized to execute said agreement <br /> <br />for and on behalf of the City of Redwood City. <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />8985 <br />
