<br />CGM:djg-c 1/14/82 <br /> <br />RES 0 L UTI 0 N <br /> <br />N o. 9 03 7 <br /> <br />ORIGI NAL <br />JAN 1 8 1982 <br /> <br />RESOLUTION AUTHORIZING THE EXPENDITURE OF PUBLIC FUNDS <br />FOR THE PURPOSE OF PRESERVING LIFE AND PROPERTY IN THE <br />VICINITY OF REDWOOD CREEK (1320 ST. FRANCIS STREET); <br />AND APPROVING AGREE:r1ENT FOR CONSTRUCTION OF U1PROVE}1ENTS <br />IN CONNECTION THEREWITH <br /> <br />WHEREAS, this Council has been informed by the Director of <br /> <br />Public Works that a house at 1320 St. Francis Street is in danger <br /> <br />of sliding into Redwood Creek as a consequence of the collapse <br /> <br />of a large portion of an adjacent concrete drainage channel wall <br /> <br />and earth embankment due to recent heavy rains; and <br /> <br />WHEREAS, Section 68 of the Charter of the City of Redwood <br /> <br />City provides that the City Council in the case of a great public <br /> <br />calamity, such as damage caused by flooding, may determine that <br /> <br />public necessity requires the expenditure of public funds to <br /> <br />preserve life and property without compliance with formal bidding <br /> <br />procedures; and <br /> <br />WHEREAS, this Council declares and determines that the <br /> <br />expenditure of public funds for the construction of improvements <br /> <br />in connection wi th the preservation of the house at 1320 St. <br /> <br />Francis Street necessitated by the collapse of the wall and earth <br /> <br />embankment is in the public interest as described in the <br /> <br />aforementioned section of the Redwood City Charter; <br /> <br />NOW, THEREFOHE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. This Council hereby finds that the expenditure of public <br /> <br />funds for the construction of improvements in connection with the <br /> <br />preservation of the house at 1320 St. Francis Street made necessary <br /> <br />by the collapse of the wall and earth embankment adjacent to <br /> <br />Redwood Creek is in the public interest. <br /> <br />9 037 <br />
