ORDINANCE NO. 2390 ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING CHAPTER 29 STREETS, SIDEWALKS AND DRIVEWAYS OF THE REDWOOD CITY MUNICIPAL CODE REGARDING ENGINEERING STANDARDS, WORK IN THE PUBLIC RIGHTS- OF-WAY AND REPAIR OF SIDEWALKS NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. The following constitutes the Council's findings. A. The City of Redwood City has the responsibility to manage the maintenance of sidewalks, roads, streets and rights-of-way in the City to preserve the operational safety, integrity, and function of the City's transportation system; and

01/28/2013 <br /> ORIGINAL <br /> ORDINANCE NO. 2390 <br /> ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING <br /> CHAPTER 29 STREETS, SIDEWALKS AND DRIVEWAYS OF <br /> THE REDWOOD CITY MUNICIPAL CODE REGARDING <br /> ENGINEERING STANDARDS, WORK IN THE PUBLIC RIGHTS- <br /> OF-WAY AND REPAIR OF SIDEWALKS <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> SECTION 1. The following constitutes the Council's findings. <br /> A. The City of Redwood City has the responsibility to manage the <br /> maintenance of sidewalks, roads, streets and rights-of-way in the City <br /> to preserve the operational safety, integrity, and function of the City's <br /> transportation system; and <br /> B. The manner in which utilities and other encroachments cross or <br /> otherwise occupy City roads and streets can materially affect the safe <br /> operation, maintenance, and longevity of City roads and streets; and <br /> C. It is necessary to protect the safety of the driving public by requiring <br /> that the use, occupancy and encroachments of City streets be subject <br /> to City authorization and reasonably regulated; and <br /> D. The ordinance herein was created to develop and preserve safe <br /> streets and minimize possible interFerence and impairment to the <br /> roadway, its structures, lifespan, appearance, operation and <br /> maintenance; and <br /> E. It is in the public interest for utility facilities and other encroachments to <br /> be accommodated within the City street right-of-way, when such use <br /> and occupancy does not interfere with the free and safe flow of traffic <br /> or otherwise impair the roadway or its safety, longevity, and scenic <br /> appearance, and does not conflict with the provisions of Federal, State <br /> or Local Laws or this ordinance. <br /> SECTION 2. Chapter 29 entitled "STREETS, SIDEWALKS AND <br /> DRIVEWAYS" (encompassing Municipal Code Sections 29.1 - 29.5), is hereby <br /> repealed in its entirety and replaced as stated in Section 3 below. <br /> SECTION 3.
