Section 38.15 is added to the Redwood City Municipal Code, to
read as follows:

Sec. 38.15. WATER CAPACITY CHARGE:

PURPOSE
THIS ORDINANCE is adopted in light of the following fact and circumstances,
which are hereby found and declared by the Council:

1. The City of Redwood City Public Financing Authority has issued over $72
million in revenue bonds, pursuant to authorization of the Council by resolution
adopted January 23, 2006.

2. The proceeds of the bonds are to be used to construct facilities for the
production and distribution of tertiary-treated disinfected recycled water for
landscape irrigation and industrial uses and to install artificial surfaces on athletic
fields in the City (the "Project").

3. The purposes of the Project are to reduce the demand for potable water,
which is available in only a limited amount from the City and County of San
Francisco, and to provide an alternative source of supply.

4. The Project allows the City's water system to accommodate water
demand. It is therefore appropriate that new development contribute a fair share
toward the cost of the Project (which otherwise would disproportionately fall upon
existing customers through water consumption rates).

5. The water capacity charge adopted by this Ordinance has been
considered at a public hearing held by the City Council on June 4,2007,
2007. Information supporting the capacity charge has been made available for
public review and notice of its availability has been provided as required by law.

A. ESTABLISHED. A water capacity charge is hereby established to provide
for capital facilities that improve the City's ability to supply water within the City's
service area, by increasing the supply available and reducing demand for potable

A TTY/ORD/ORD.279
053107

Ord 2312
formerly muff# 802
