03/23/2020 <br />ORDINANCE NO. 2480 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY ADDING CHAPTER 32, ARTICLE XIII TO THE <br />REDWOOD CITY MUNICIPAL CODE TO ESTABLISH A SPECIAL <br />TAX FINANCING LAW <br />WHEREAS, the City of Redwood City (the "City") has broad constitutional "home <br />rule" authority as a California charter city, pursuant to State Constitution Article XI, <br />Section 5; and <br />WHEREAS, City Charter Section 3 provides that, except as prohibited by the <br />State Constitution or restricted by the City Charter, the City shall and may exercise all <br />municipal powers, functions, rights, privileges and immunities of every name and nature <br />whatsoever, and that the enumeration of particular powers by the Charter shall not be <br />deemed to be exclusive, it being intended that the City shall have and may exercise all <br />powers which, under the State Constitution, it would be competent for the City Charter <br />to enumerate; and <br />WHEREAS, City Charter Section 71 provides that general laws of the State <br />applicable to municipal corporations, including those relating to "municipal affairs," and <br />which are not in conflict with the provisions of the City Charter or with ordinances or <br />resolutions hereafter enacted shall be applicable to the City; and <br />WHEREAS, the Mello -Roos Community Facilities Act of 1982 (Chapter 2.5, <br />commencing with Section 53311 of Part 1, Division 2, Title 5 of the California <br />Government Code; the "Mello -Roos Act'), provides an alternative method of financing <br />certain public capital facilities and services through the levying of special taxes and the <br />incurrence of bonded indebtedness and other debt within the boundaries of a <br />community facilities district; and <br />WHEREAS, Section 53311.5 of the Mello -Roos Act provides that the Mello -Roos <br />Act shall not affect or limit any other provisions of law authorizing or providing for the <br />furnishing of governmental facilities or services or the raising of revenue for these <br />purposes; and <br />WHEREAS, the City wishes to exercise its power pursuant to State Constitution <br />Article XI, Section 5 and City Charter Section 3 to establish a system by which it may <br />levy special taxes to finance capital facilities and services within the boundaries of the <br />City, and such system is supplemental to, and not in conflict with, alternative taxing <br />systems identified in the City Charter and in the laws of the State of California, including <br />the Mello -Roos Act; and <br />WHEREAS, the City Council has considered all information related to this matter, <br />as presented at the public meeting of the City Council identified herein, including any <br />supporting reports by City Staff, and any information provided during public meetings. <br />ATTY/ORD.515/CC ORD ADDING CHAPTER 32 ARTICLE XIII TO ESTABLISH SPECIAL TAX FINANCING LAW ORDINANCE NO. 2480 <br />REV: 03-02-2020 PR MUFF N0, 305 <br />Page 1 of 4 <br />
