09/14/2020 <br />RESOLUTION NO. 15886 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY UPHOLDING THE DECISION OF THE PLANNING COMMISSION <br />DENYING ARCHITECTURAL PERMIT NO. AP2020-015 FOR 1652 <br />CARLETON COURT AND DETERMINING THIS ACTION TO BE <br />EXEMPT FROM CEQA UNDER CEQA GUIDELINES SECTION 15270 <br />WHEREAS, the applicant, Matt Lopez and Mark Johnson (Applicant) applied for <br />an Architectural Permit to construct a two story home exceeding 3,000 square feet (the <br />Project) at 1652 Carleton Court (the Property); and <br />WHEREAS, the Council is empowered to call up and act upon Architectural <br />Permits for single family dwellings, including those that exceed the "soft cap" of 3,000 <br />total square feet or Floor Area Ratio of 45 percent, whichever is greater, under Zoning <br />Ordinance Article 48; and <br />WHEREAS, on June 16, 2020, following a duly -noticed public hearing, and after <br />fully considering the staff report and attachments prepared for the Project, oral and <br />written public testimony, and all other documents and evidence in the public record on <br />the Project, the Planning Commission directed staff to return to the Commission with a <br />formal resolution denying the Project based on its inability to make required findings, <br />specifically Section 45.4(C) and Section 48.4(A); and <br />WHEREAS, on July 21, 2020, the Planning Commission formally denied the <br />application by adopting Resolution 20-02; and <br />WHEREAS, on July 27, 2020, the City Council called up the decision for further <br />review; and <br />WHEREAS, on September 4, 2020, a public hearing notice was published in the <br />San Mateo Daily Journal and mailed to interested parties and all property owners within <br />300 feet of the Property; and <br />WHEREAS, on September 14, 2020, the City Council held a duly noticed public <br />hearing in accordance with all applicable requirements of the State Planning and Zoning <br />Law and the Redwood City Zoning Ordinance, to consider the Project; and <br />ATTY/RESO.0089/CC RESO DENYING ARCHITECTURAL PERMIT FOR 1652 CARELTON COURT RESO.
