11/23/2020 <br />RESOLUTION NO. 15917 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY CALLING A SPECIAL ELECTION IN THE CITY OF REDWOOD <br />CITY COMMUNITY FACILITIES DISTRICT NO. 2020-1 (SEAPORT <br />CENTRE/SEAPORT PLAZA) <br />WHEREAS, under City of Redwood City's (the "City") Special Tax Financing Law <br />(Chapter 32, Article XIII of the Redwood City Municipal Code) (the "CFD Law") which <br />incorporates the Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), <br />this City Council (the "City Council") is authorized to establish a community facilities <br />district and to act as the legislative body for a community facilities district; and <br />WHEREAS, this City Council has adopted a resolution entitled "A Resolution of <br />the City Council of the City of Redwood City Forming City of Redwood Community <br />Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza), and Approving Related <br />Documents and Actions" (the "Resolution of Formation"), ordering the formation of the <br />"City of Redwood City Community Facilities District No. 2020-1 (Seaport Centre/Seaport <br />Plaza)" (the "CFD"), authorizing the levy of special taxes on property within the CFD and <br />preliminarily establishing an appropriations limit for the CFD, all pursuant to the CFD <br />Law and <br />WHEREAS, this City Council has also adopted a resolution entitled "A Resolution <br />of the City Council of the City of Redwood City Determining Necessity to Incur Bonded <br />Indebtedness and Other Debt Payable from Special Taxes Levied in City of Redwood <br />City Community Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza), and <br />Approving Related Documents and Actions" (the "Resolution Determining Necessity"), <br />determining the necessity to incur bonded indebtedness and other debt (as defined in <br />the Act) in the maximum aggregate principal amount of $25,000,000 upon the security <br />of the Facilities Special Tax (as defined in the Resolution of Formation) to be levied <br />within the CFD pursuant to the CFD Law; and <br />WHEREAS, pursuant to the provisions of the Resolution of Formation and the <br />Resolution Determining Necessity, the propositions of the levy of the special taxes <br />described in the Resolution of Formation, the establishment of the appropriations limit <br />and the incurring of the bonded indebtedness and other debt shall be submitted to the <br />qualified electors of the CFD as required by the provisions of the CFD Law; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. Issues Submitted. Pursuant to Sections 53326, 53351 and <br />53325.7 of the Act, the issues of the levy of the special taxes described in the <br />Resolution of Formation, the incurring of bonded indebtedness and other debt and the <br />establishment of the appropriations limit shall be submitted to the qualified electors (as <br />defined below) of the CFD at an election called therefor as provided below. <br />ATTY/RES0.0133/CC RESO CALLING FOR SPECIAL ELECTION RWC CFD SEAPORT RESO.
