Code § <br />27383. <br />IMPROVEMENT AGREEMENT <br />610 Walnut Street <br />TI -I 1 PROVE ENT AGREEMENT ("Agreement") is made and entered into on <br />this day I , 2020 ("Effective Date") by and between WINDY HILL PV <br />FIVE CM, LV, a California limited liability company ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") (together, <br />the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.416 acres located within the City of Redwood City, County of San Mateo, <br />State of California, commonly known as 610 Walnut Street, described in Exhibit "A", <br />attached hereto and incorporated herein by reference (the "Property"). <br />B. On February 19, 2019, the Planning Commission of the City of Redwood <br />City adopted, among other approvals, Resolution No. 19-01, approving the Tentative Map <br />for the development of a six -story 65,080 square foot building located at 610 Walnut <br />Street ("Project"), prepared by Arc Tec, Architectural Technologies and dated November <br />9, 2018 ("Tentative Map"), subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the parcel map ("Parcel Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Parcel Map and applied to City for Parcel Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66411.1. <br />E.
