Box 391, Redwood City, CA 94064, <br /> <br />herein "Lessee"; <br /> <br />WITNESSETH: <br /> <br />1. Lessor hereby leases to Lessee the premises of Lessor <br />located at Redwood City (Redwood Harbor), County of San Mateo, State <br />of California ("premises"), in the approximate location illustrated <br />on the -print of Lessor's Drawing No. R-1938, Sheet No.1, revised <br />April 14, 1985, attached and made a part hereof. <br /> <br />Lessor reserves for itself, its successors, assigns and <br />licenses the right to construct, maintain and operate existing <br />tracks and existing and future pipes, communication and power <br />transmission lines, and drainage ditches or facilities located upon, <br />over and beneath the premises. <br /> <br />2. This lease shall be for the term of one (1) year from the <br />above date, provided that either party may terminate this lease upon <br />thirty (30) days' advance written notice to the other party. Any <br />holding over after the original term shall be a tenancy from moth to <br />month upon the same terms and conditions hereof. <br /> <br />3. As rental for the premises, Lessee shall pay to Lessor the <br />sum of Two Thousand Four Hundred Dollars ($2,400) per annum, payable <br />annually in advance, subject to provisions of Section 14 hereof. <br /> <br />4. Any privilege, sales, gross income, or other tax (not <br />including income tax) imposed upon the rentals herein, or upon <br />Lessor in an amount measured by the rentals, shall be paid by <br />Lessee. <br /> <br />5. Absence of markers does not constitute a warranty by <br />Lessor of no subsurface installations. <br /> <br />6. The premises shall be used for beautification purposes <br />only. No trees shall be planted on the premises without the prior <br />written approval of Lessor. No trees or shrubs shall be permitted <br />to encrach within fifteen (15) feet of the centerline of any <br />track. <br />
