\ ~it\ RESOLUTION NO. 199 FOR SALE OF PROPERTY AT DUANE STREET AND HARRISON AVENUE WHEREAS, the real property hereinafter described has here- tofore been appraised by a competen t dis.interested appraiser ap- pointed by this Council, and public notice of the sale of said property, containing a legal description thereof, has been given for at least two weeks in the Tribune, a newspaper published daily except Sunday in this city, as appears fronl the Affidavit of Publi- cation now on file with the City Clerk; and WHE-REAS, JAMES B. MURPHY has made a wri tten bid for the purchase of said property and has offered therein to pay the sum of $ 275.00 , which bid is the highest and best bid therefor, and which bidder has made the highest and best bid for said property in accordance with said notice of sale thereof, and said bid is not less than ninety per cent of such appraised value; RESOLVED that said bid of said JAMES B. MURPHY to purchase said property for the sum of $ 275.00 , be and the same is hereby accepted and said property is hereby sold to said bidder for said sum, payable in cash wi thin fifteen (15) days after the date of this resolution; Said property is sold subject to anasses.sment unpaid to said city for the construction of sidewall{s on Duane Street and Har- rison Avenue along the fron t and side of said property, and also subject to an easement for a natural water course, to wit, a creek through said property, in a general northeasterly and soutbwesterly direction, which creek must remain ~~obstructed and unaffected by any use of the remainder of said property.
