Code § <br />27383. <br />IMPROVEMENT AGREEMENT <br />Stanford Health Care Douglas Avenue Electrical Utilities Undergrounding <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on <br />this day of kAA-Y !p , 2021 ("Effective Date") by and between Stanford Health <br />Care, a nonprofit public benefit corporation ("Developer"), and the CITY OF REDWOOD <br />CITY, a charter city and California municipal corporation ("City") with Developer and City <br />hereinafter referred to individually as "Party" and collectively as "Parties." Reference is <br />made to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property located <br />within the City of Redwood City, County of San Mateo, State of California, described in <br />Exhibit "A", attached hereto and incorporated herein by reference (the "Property"). <br />B. On September 9, 2013, the City Council of Redwood City adopted, among <br />other approvals, Resolution No. 15295, adopting the Stanford in Redwood City Precise <br />Plan ("Precise Plan") including the guidelines, policies, and standards contained therein. <br />C. Chapter II, Section IV, Subsection N of the Precise Plan requires that <br />existing above -ground utility lines shall be placed underground per City requirements <br />along Broadway, Bay Road and Douglas Avenue as development occurs, and that the <br />minimum length of undergrounding segment shall be one block ("Overhead Utility Lines <br />Requirement"). <br />D. The Property is located within the area subject to the Precise Plan, and <br />development is subject to the applicable guidelines, policies, and standards contained <br />therein, including the Overhead Utility Lines Requirement. <br />E. On July 19, 2019, Developer submitted to the City a Planned Community <br />Permit ("PC Permit") application and Tentative Map application in connection with <br />planned development of the Property (Permit Numbers PC2019-003 and TM2019-005, <br />respectively) and the proposed development is subject to the Overhead Utility Lines <br />Requirement where such requirement has not already been met, namely on Douglas <br />Avenue, north of Broadway. <br />REV: 01-12-2021 PR <br />ATTY/AGR.2021.006/Stanford Medical (Page 1 of 22) <br />
