Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />1548 Maple <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and <br />entered into this �6 'day of FV!5Zu-t-w( , 2021 ("Effective Date"), by and between <br />1548 Maple LLC, a Delaware limited liability company ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") with <br />reference to the following facts: <br />RECITALS <br />A. Reference is made to that certain real property situated in the City of <br />Redwood City, County of San Mateo, State of California, known as the 1548 Maple <br />Project ("Site") and described on Exhibit "A", attached hereto and incorporated by this <br />reference as if fully set forth herein (the "Property"). The Property is being developed as <br />a residential townhome community. City and Developer anticipate that Developer will <br />assign its interest in the common area portions of the Property to a to be formed <br />homeowners' association ("HOA"), that is anticipated to be a California nonprofit mutual <br />benefit corporation, which HOA will be ultimately responsible for the management, <br />operation and governance of the common area portions of the Property, including the <br />Improvements (defined below) thereon. <br />B. In connection with its development of the Property as a residential <br />townhome community, Developer submitted to City Improvement Plans, which include, <br />inter alia, landscaping plans for along the Property frontage ("Plans"), all of which Plans <br />have been approved by City. The Plans provide for installation of certain landscaping, <br />pedestrian lighting, irrigation, street trees, paths, and sidewalk ("Improvements") within <br />the property frontage on Maple and Blomquist Streets, and along the path adjacent to <br />Redwood Creek ("Maintenance Area") as the Improvements and Maintenance Area are <br />more specifically shown on Exhibit "B" attached hereto and incorporated by this reference <br />as if fully set forth herein. <br />C.
