<br />RES 0 L UTI 0 N <br /> <br />N O. 639" <br /> <br />AUTHORIZING CONTRACT TO PAY COST OF WATER <br />SYSTEM - EMERALD LAKE HEIGHTS <br /> <br />WHEREAS, NELSON M. WELBANKS and the CITY OF REDWOOD <br />CITY entered into an agreement on February 3, 1947 whereby <br />NELSON M. WELBANKS agreed to install a water system in the <br />subdivision known as Emerald Lake Heights and to convey title <br /> <br />to said water system to the CITY OF REDWOOD,CITY, and the <br /> <br /> <br />CITY OF REDWOOD CITY agreed to construct a certain water main <br /> <br />connecting said water system to the CITY OF REDWOOD CITY'S <br /> <br />water system; and <br /> <br />WHEREAS, the CITY OF REDWOOD CITY and NELSON M. <br /> <br />WELBANKS entered into an agreement subsequent to the agree- <br />ment dated February 3, 1947 whereby NELSON M. WELBANKS was to <br />install the water main originally to be installed by the CITY <br />OF REDWOOD CITY and in return the CITY OF REDWOOD CITY was to <br /> <br />pay the cost of such installation to NELSON M. WELBANKS; and <br /> <br />WHEREAS, some controversy has arisen over the rights <br /> <br />of the CITY OF REDWOOD CITY and NELSON M. WELBANKS under that <br /> <br />subsequent agreement, and the CI1rY OF REDWOOD CITY is desirous <br /> <br /> <br />of settling and determining finally the rights and liabilities <br /> <br /> <br />of the parties under t hat subsequent agreement; <br /> <br />NOW THEREFORE, BE IT RESOLVED that the CITY MANAGER <br /> <br />of the CITY OF REDWOOD CITY be, and he hereby is authorized <br />and directed to enter into a contract with NELSON M.
