Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />South Main - Block C <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and <br />entered into this 26 day of "A:- I . 2022 ("Effective Date"), by and between <br />Benjamin Kopf Holding Co., a California corporation ("Kopf' and "Owner"), IQHQ Elco <br />Yards, L.P., a Delaware limited partnership ("IQHQ" and "Developer"), and the City of <br />Redwood City, a charter city and California municipal corporation ("City") (together, the <br />"Parties") with reference to the following facts: <br />RECITALS <br />A. Kopf is the current fee owner of that certain real property consisting of <br />approximately 1.50 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). Kopf and IQHQ have entered into a ground lease whereby <br />IQHQ is leasing the Property from Kopf to develop the Property. For purposes of this <br />Agreement, the "Property" shall consist of Kopf's fee interest and IQHQ's leasehold <br />interest in that property described in Exhibit "A". <br />B. On November 16, 2020, the City Council of the City of Redwood City <br />adopted, among other approvals, Resolution No. 15908, approving a mixed-use project, <br />on the Property subject to certain conditions of approval ("Conditions"). <br />C. In compliance with the Conditions, Developer submitted to City landscaping <br />plans for the Property frontage ("Plans"), which have been approved by City. The Plans <br />provide for installation of certain landscaping, pedestrian lighting, irrigation, sidewalk <br />("Improvements") within the property frontage and easement areas ("Maintenance Area") <br />as the Improvements and Maintenance Area are more specifically shown on Exhibit "B" <br />attached hereto and incorporated by this reference as if fully set forth herein. <br />D.
