Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />South Main - Block D <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and <br />entered into this .05 day of 4ef-= I-- , 2022 ("Effective Date"), by and between <br />IQHQ TRS Elco Yards, Inc., a Delaware corporation ("Developer"), and the City of <br />Redwood City, a charter city and California municipal corporation ("City") (together, the <br />"Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 1.27 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On November 16, 2020, the City Council of the City of Redwood City <br />adopted, among other approvals, Resolution No. 15908, approving a mixed-use project, <br />on the Property subject to certain conditions of approval ("Conditions"). <br />C. In compliance with the Conditions, Developer submitted to City landscaping <br />plans for the Property frontage ("Plans"), which have been approved by City. The Plans <br />provide for installation of certain. landscaping, pedestrian lighting, irrigation, sidewalk <br />("Improvements") within the property frontage and easement areas ("Maintenance Area") <br />as the Improvements and Maintenance Area are more specifically shown on Exhibit "B" <br />attached hereto and incorporated by this reference as if fully set forth herein. <br />D. Developer has submitted a final map for the Property, which has been <br />reviewed by the City Engineer and is being approved concurrently with this Agreement <br />("Final Map"). <br />E. Developer recognizes that City's approval of the Final Map is based on <br />Developer's commitment to the long-term maintenance, repair, care and, if and when <br />necessary, replacement of the Improvements, and that the Final Map would not have <br />REV: 04-07-2022 SK <br />Exempt from fee per GC 27388.1(a) (1); <br />fee cap of $225 reached <br />ATTY/AGR.2022.076/LMA (Page 1 of 17) <br />
