Code §27383 LANDSCAPE MAINTENANCE AGREEMENT South Main - Block D THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into this .05 day of 4ef-= I-- , 2022 ("Effective Date"), by and between IQHQ TRS Elco Yards, Inc., a Delaware corporation ("Developer"), and the City of Redwood City, a charter city and California municipal corporation ("City") (together, the "Parties") with reference to the following facts: RECITALS A. Developer is the current fee owner of that certain real property consisting of approximately 1.27 acres located within the City of Redwood City, County of San Mateo, State of California, described in Exhibit "A", attached hereto and incorporated herein by reference (the "Property"). B. On November 16, 2020, the City Council of the City of Redwood City adopted, among other approvals, Resolution No. 15908, approving a mixed-use project, on the Property subject to certain conditions of approval ("Conditions"). C. In compliance with the Conditions, Developer submitted to City landscaping plans for the Property frontage ("Plans"), which have been approved by City. The Plans provide for installation of certain. landscaping, pedestrian lighting, irrigation, sidewalk ("Improvements") within the property frontage and easement areas ("Maintenance Area") as the Improvements and Maintenance Area are more specifically shown on Exhibit "B" attached hereto and incorporated by this reference as if fully set forth herein. D. Developer has submitted a final map for the Property, which has been reviewed by the City Engineer and is being approved concurrently with this Agreement ("Final Map"). E. Developer recognizes that City's approval of the Final Map is based on Developer's commitment to the long-term maintenance, repair, care and, if and when necessary, replacement of the Improvements, and that the Final Map would not have REV: 04-07-2022 SK Exempt from fee per GC 27388.1(a) (1); fee cap of $225 reached ATTY/AGR.2022.076/LMA (Page 1 of 17)
