REV: 07-19-22 JB <br />AGREEMENT TO TEMPORARILY RELOCATE THE <br />MAIN STREET DOG AGILITY PARK DURING CONSTRUCTION <br />THIS AGREEMENT TO TEMPORARILY RELOCATE THE MAIN STREET <br />DOG AGILITY PARK DURING CONSTRUCTION (this “Agreement”) is made and entered <br />into as of ______, 2022 (“Effective Date”) by and between The CITY OF REDWOOD, a charter <br />city and California municipal corporation (“City”); IQHQ ELCO YARDS, LP, a Delaware limited <br />partnership (“IQHQ”) (together, the “Parties”) with reference to the following facts: <br />Recitals <br />A. On November 16, 2020, the City Council conditionally approved the South Main Mixed <br />Use project known now as “Elco Yards” (“Project”) located at 1601 El Camino Real, between El <br />Camino Real, Maple, Cedar and Main Streets. <br />B. Condition of Approval No. 94 of the Project (“COA 94”) requires IQHQ to provide <br />sufficient barriers and protections during construction of the Project to allow the continued use of <br />Main Street Dog Agility Park (“Dog Park”). <br />C. COA 94 also requires IQHQ to provide an option to temporarily relocate the Dog Park, <br />if construction activity generates noise, dust, or otherwise inhibits the ability for the public to <br />continue to use the Dog Park in a similar capacity as pre construction. <br /> <br />D. The Project requires IQHQ to provide underground public improvements within the <br />Beech Street right-of-way area including sewer, storm water, and recycled water improvements <br />and construction of these improvements will impact use of the Dog Park. <br />E. IQHQ has diligently pursued efforts to identify and secure property rights in a suitable <br />location for the temporary relocation of the Dog Park and has presented multiple options to the <br />City, including an approximately 0.5-acre City owned parcel located along Spring Street, Walnut <br />Street and Marshall Street in Redwood City, as shown on the attached as Exhibit A and designated <br />for park use (“Parklet Site”). <br />F. COA 94 requires that the temporary relocation area serve the same neighborhood and <br />be similar in size, access, and facilities as the Dog Park and the Parties agree that the Parklet Site <br />is an acceptable location to meet these requirements of COA 94. <br />G. COA 94 also requires IQHQ to provide at its expense, barriers with appropriate gates, <br />dog bag stations, and drinking foundations, at the temporary location, and is required to provide a <br />preservation and replacement plan, cataloging and preserving existing features, including trees, <br />structures and signage, and to restore the Dog Park to the City’s satisfaction at IQHQ’s sole <br />expense. <br />H. IQHQ submitted a construction logistics plan to the City which provided for the closure <br />of portions of the Dog Park and demonstrated the proposed interim treatment of the Dog Park <br />during construction which aimed at preservation and replacement, cataloging and preserving <br />existing features, including trees, structures and signage, to have the least impact as possible on <br />ATTY/AGR.2022.180/IQHQ (Elco Yards Temporary Dog Park) (Page 1 of 13) <br />July 28
