10/26/2009 <br />ORIGINAL <br />RESOLUTION NO. 14979 <br />RESOLUTION FINDING AND DETERMINING THAT, BECAUSE OF LOCAL <br />CONDITIONS, THE PUBLIC HEALTH, SAFETY, WELFARE, AND <br />NECESSITY, REQUIRE THE ADDITION OF ARTICLE X OF CHAPTER 9 OF <br />THE MUNICIPAL CODE OF THE CITY OF REDWOOD CITY ADOPTING A <br />GREEN BUILDING CODE <br />WHEREAS, the City Council of the City of Redwood City proposes to enact <br />an ordinance adding Sections 9.180 -9.185 to the Redwood City Municipal Code, <br />consisting of a Green Building Code ( "the Ordinance "); and <br />WHEREAS, California Health and Safety Code Sections 18938 and 17958 <br />provide that the California Building Standards Code establishes building standards <br />for all occupancies throughout the State; and <br />WHEREAS, Sections 17958.5 and 17958.7 of the California Health and <br />Safety Code enable a city to make changes and modifications to the California <br />Building Standards, where the governing body makes express findings that such <br />changes are reasonably necessary because of local climatic, geological or <br />topographical conditions; and <br />WHEREAS, in connection therewith, the Ordinance will result in certain <br />modifications and changes to the substantive provisions of the California Building <br />Standards, which changes or modifications are reasonably necessary due to local <br />conditions (the "Local Amendments "); and <br />WHEREAS, this action is categorically exempt from CEQA pursuant to <br />Section 15308 of the California Code of Regulations ( "CEQA Guidelines "), which <br />exempts actions taken by regulatory agencies for enhancement or protection of <br />ATTY /RESO /RESO.1950 <br />100509 <br />#14979 <br />MUFF # 305 <br />1 <br />
