ATTY/ORD.0012/CC ORD AMENDING ARTICLE I, II, & III OF REDWOOD CITY MUNICIPAL CODE <br />REV: 11-05-25 MI <br />Page 1 of 2 <br />ORDINANCE NO. 2555 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY AMENDING ARTICLE I (IN GENERAL), ARTICLE II (REFUSE <br />RECEPTACLES) AND ARTICLE III (COLLECTION AND DISPOSITION <br />OF REFUSE) IN CHAPTER 14 OF THE REDWOOD CITY MUNICIPAL <br />CODE <br />WHEREAS, the Redwood City Municipal Code Chapter 14 (Refuse, Weed, <br />Nuisance, and Abandoned Shopping Cart Regulation and Abatement) governs the <br />management, storage, processing, collection, and disposal of solid waste, recyclables, <br />and organic materials within Redwood City; and <br />WHEREAS, the City recently amended its Franchise Agreement with Recology to <br />specify that Recology will be responsible for preparing and collecting Bills and to allow <br />the City to set franchise fees by resolution, thereby providing the City with the opportunity <br />to adopt fees that correspond with the Franchise Fee Study it adopted on January 27, <br />2025; and <br />WHEREAS, the City wishes to revise its Municipal Code to reflect these changes <br />in the Franchise Agreement and to make other clarifications. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The above recitals are true and correct, and incorporated herein by <br />reference and each is relied upon independently by the City Council for its adoption of the <br />Ordinance. <br />Section 2. The Ordinance has been reviewed with respect to applicability of the <br />California Environmental Quality Act (“CEQA”) and the CEQA Guidelines. The Ordinance <br />is not project under Public Resources Code Section 21065 and California Environmental <br />Quality Act (“CEQA”) Guidelines Section 15378(b)(5) because the Ordinance is an <br />organizational or administrative activity that will not result in direct or indirect physical <br />changes in the environment. The Ordinance is also exempt from CEQA as there is no <br />possibility for causing a significant effect on the environment, per CEQA Guideline <br />Section 15061(b)(3). <br />Section 3. Articles I, II, and III of Chapter 14 of the Redwood City Municipal Code <br />are hereby deleted in their entirety and replaced with the text as set forth in Exhibit A, <br />attached hereto and incorporated by reference herein. <br />Section 4. If any provision, section, paragraph, sentence or word of this <br />Ordinance, or the application thereof to any person or circumstance, is rendered or <br />declared invalid by any court of competent jurisdiction, the remaining provisions, sections, <br />paragraphs, sentences or words of this Ordinance, and their application to other persons
