RESOLUTION NO. 1$51 <br />GRANTING VARIANCE TO DOCTOR E. M. COHEN <br />TO ALLOW FIVE FOOT REAR YARD, LOT 15, <br />BLOCK 5, DINGEE PARK. <br />WHEREAS, the Planning Commission of Redwood City has submitted <br />the application of DOCTOR E. M. COHEN for a variance with the <br />recommendation that such application be granted; <br />NOW, THEREFORE, the Council of Redwood City hereby resolves <br />as follows : <br />1. Said Council finds the following conditions exist: <br />(a) That there are exceptional or extraordinary <br />circumstances which apply to the land, build- <br />ing or use referred to in the application, <br />which circumstances or conditions'do not <br />generally apply to lands, buildings or uses <br />in the same district. <br />(b) That the granting of the application is <br />necessary for the preservation and enjoyment <br />of substantial property rights of the petitioner. <br />(c) That the granting of such application will not <br />materially affect adversely neighboring <br />property or the public welfare, health or <br />safety of persons residing or working in the <br />neighborhood. <br />2. Said Council hereby grants DOCTOR E. M. COHEN a variance <br />to allow reduction of a rear yard on Lot 15, Block 5, Dingee Park, <br />to five feet (5') instead of fifteen feet (15') subject to the <br />condition that all construction shall be in accordance with the <br />plan heretofore submitted to the Planning Commission and Council <br />of Redwood City and that said construction will be diligently prose- <br />cuted to completion not later than one year from the date hereof. <br />
