D!.~~g_~~ P ~RK ___'.'_. <br /> <br />l'.JHEREAS, the Planning Corrunission of Redw,ood Ci ty has sub- <br />mitted the application of E. M. deCOUX for a variance with the <br /> <br />r'ecommendation that such application be granted, <br /> <br />NOW, rrHEREFOHE, THE COUNCIL OF REDvJOOD CITY HEREBY RESOLVES <br /> <br />AS FOLLOVJS: <br /> <br />1. Said Council finds the following conditions exist: <br /> <br />(a) That there are exceptional or extraordinary <br />circumstances which apply to the land, building <br />or use referred to in the application, which <br />circumstances or conditions do not generally <br />apply to lands, buildings, or uses in the same <br />district. <br /> <br />(b) That the granting of the application is <br />necessary for the preservation and enjoyment <br />of substantial property rights of the <br />petitioner. <br /> <br />(c) That the granting of such application will <br />not materially affect adversely neighboring <br />property or the public welfare or the health <br />or safety of persons residing or working in <br />the neighborhood. <br /> <br />2. Said Council hereby grants to E. M. deCOUX a variance <br /> <br />to allow a five foot (51) rear yard on Lot 9, Block 11, Dingee <br /> <br />Park, for the purpose of constructing thereon a medical building, <br /> <br />subject to the following conditions: <br /> <br />(a) <br /> <br />There shall be no construction, includl ng an~r <br />overhang, which encroaches in any way on the <br />rear five feet .i .. of the property. <br /> <br />(b) <br /> <br />All of the construction shall be in strict <br />accordance with the plans heretofore submitted <br />to the Planning Conmlission and the Council of <br />Redwood City, with the exception of the <br />encroachment on the flve foot area, provided <br />in (a) hereof. <br /> <br />(c) <br /> <br />All constructlon shall be diligently completed <br />not later than six (6) months from the date of <br />this Resolution. <br /> <br />-1- <br />
