<br />RES 0 L UTI 0 N <br />---------- <br /> <br />NO. 2108 <br /> <br />GRANTING VARIANCE FROM CERTAIN PROVISIONS <br />OF THE ZONING ORDINANCE OF THE CITY OF <br />REDWOOD CITY TO JOHN D. TEHANEY <br /> <br />~nIEREAS, John D. Tehaney has made application to the <br /> <br />Board of Adjustments of the Planning Cooouission of the City of <br /> <br />Redwood City for a variance from the strict application of cer- <br /> <br />tain provisions of Ordinance No. 600 (the Zoning Ordinance of <br /> <br /> <br />the City of Redwood City) in accordance with Sections 2.02 and <br /> <br />2.04 of said ordinance; and, <br /> <br />wtiEREAS, said Board has held at least one public hearing <br /> <br />with reference to said application; has recommended that this <br /> <br />Council grant said application subject to stated conditions; and, <br /> <br />has found that the following conditions exist: <br /> <br />(a) That there are exceptional or extraordinary circum- <br />stances which apply to the land, building or use <br />referred to in the application, which circumstances <br />or conditions do not generally apply to lands, <br />buildings or uses in the same district. <br /> <br />(b) That the granting of the application is necessary <br />for the preservation and enjoyment of substantial <br />property rights of the petitioner. <br /> <br />(c) That the granting of such application will not <br />materially affect adversely neighboring property <br />or the public welfare or the health or safety of <br />persons residing or working in the neighborhood. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF REDWOOD CITY: <br /> <br />1. This Council hereby approves the abovementioned findings <br /> <br />of the Board of Adjustments of the Planning Co~mission and confirms <br /> <br />the same. <br /> <br />2. In accordance with Section 2.01 of Ordinance No. 600, <br /> <br />this Council does hereby grant to John D. Tehaney a variance from <br /> <br />the strict application of the provisions of said Ordinance, sub- <br /> <br />ject to the conditions hereinafter set forth, as follows: <br /> <br />Variance from setback from side yard requirements <br />of Ordinance No. 600 (the Zoning Ordinance of the <br />City of Redwood City) to allow 5' side yard on <br />
