"1 <br /> <br />. <br /> <br />. <br /> <br />ORiGINAL <br /> <br />RE~OLUT.:ION <br /> <br />NO. 6 0 '60 <br /> <br />MG 25 '69 <br /> <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br />FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND <br />NECESSITY REQUIRE THE ACQUISITION AND CONSTRUCTION BY <br />THE CITY OF REDWOOD CITY OF A PUBLIC IMPROVEMENT, NAMELY, <br />A PUBLIC STREET, IN AND UPON THAT CERTAIN REAL PROPERTY <br />HEREIN DESCRIBED: THAT THE ACQUISITION OF ~ RIGHT OF WAY <br />AND EASEMENTS IN SAID REAL PROPERTY HEREIN DESCRIBED IS <br />NECESSARY FOR SAID .PUBLIC IMPROVEMENT: AUTHORIZING THE <br />CITY ATTORNEY TO BRING AN ACTION IN EMINENT DOMAIN TO <br />ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC IMPROVE~iliNT <br />AND TO APPLY FOR AN ORDER OF IMMEDIATE POSSESSION OF <br />SAID REAL PROPERTY: AND AUTHORIZING AND DIRECTING THE <br />CITY ~AGER TO DEPOSIT MONEY FOR IMMEDIATE POSSESSION <br />OF SAID REAL PROPERTY <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br /> <br />CITY, AS FOLLOWS: <br /> <br />That it hereby finds and determines and declares: <br /> <br />That the public interest and necessity require the <br /> <br />acquisition and construction by the City of Redwood city of <br /> <br />a public improvement, namely, a public street and appurtenances, <br /> <br />in and upon that certain real property hereinafter described: <br /> <br />That the acquisition by the City of Redwood City of a <br /> <br />right of way and easements in and upon that certain real pro- <br /> <br />perty hereinafter described is necessary for said public <br /> <br />improvement: <br /> <br />That said publ~c improvement is the use to which said <br /> <br />real proper~y is to be applied, and that said use is a public <br /> <br />use authorized by law: <br /> <br />That said public improvement.is planned and located in the <br /> <br />manner which will be most compatible with the greatest public <br /> <br />good and the least private injury: <br /> <br />AND, BE IT FURTHER RESOLVED:. <br /> <br />That the City of Redwood City acquire said right of way <br /> <br />and easements in and upon said real property for said public <br /> <br />improvement by an action in eminent domain in accordance with <br /> <br />the provisions of the Charter of the City of Redwood City, the <br /> <br />provisions of Article I, Section 14, .of the Constitution of <br /> <br />the State of California, and the provisions of the Code .of <br /> <br />civil Procedure of the State of California relating to eminent <br />
