RES 0 L UTI o N N O. ---------- RESOLUTION OF THE COUNCIL OF' THE CITY OF REDWOOD CITY FINDING AND DETERl-1INING TI-L1\T THE PUBLIC INTEREST' AND NECESSITY REQUIRE THE ACQUISITION AND CONSTRUCTION BY THE CITY OF REDWOOD CITY OF A PUBLIC IMPROVEMENT, NJi.MELY, A PUBLIC STREET, IN AND UPON THAT CERTAIN REAL PROPERTY HEREIN DESCRIBED; TH.Z\.T THE ACQUISITION OF, A RIGHT OF WAY AND EASEMENTS IN SAID REAL PROPERTY HEREIN DESCRIBED IS NECESSARY FOR SAID PUBLIC IHPROVEf.1ENT; AUrrHORIZING THE CITY ATTORNEY TO BRING AN ACTION IN EMINENT DOMAIN TO ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC IMPROVEMENT AND TO APPLY FOR AN ORDER OF IIv1f:1EDIATE POSSESSION OF SAID, REAL PROPERTY; AND AUTHORIZING AND DIREC1'ING THE CITY HANAGER TO .DEPOSIT MONEY FOR I~~lliDIATE POSSESSION OF SAID REAL PROPERTY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: That it hereby finds and determines and declares: That.the public interest and necessity require the acquisition and construction by the City of Redwood City of a public improvement, namely, a public street and appurtenances, in and upon that certain real property hereinafter described; That the acquisition by the City of Redwood City of a right of way and easements in and upon that certain real property hereina'fter described is necessary for said public improvement; That said public improvement is the use to which said real property is to be applied, and that said use is a public use authorized by law; That said public improvement is planned and located in the manner which will be most compatible with the, greatest public good and the least private injury; AND, BE IT FURTHER RESOLVED: That the City of Redwood City acquire said right of way and easements in and upon said real property for said public improvement by an action in eminent domain in accordance with the provisions of the Charter of the City of Redwood City, the provisions of Article I, section 14, of the Constitution of the state of California, and the provisions of the Code of civil Procedure of the State of California relating to eminent domain, said real property and easements being more, particularly described as follows A perpetual easement and right of way foi street purposes and for public utility purposes, including the right to excavate, 'install, replace (of the initial or any other size), maintain, repair and use such street and utility facilities, together with appurtenances thereto, as the City of Redwood City shall from time to time elect, within the real property situate in the City of Redwood City, County of S?n Mateo, State of California, more particularly described as follows: .
