DES:yc:9/24/68 REE.OLUT1.0N N O. ~Pt)3 O r.~ !I"\ U\I i ~ 1 " i n, L\ L "-'<11'\11 ell 2,1 '''.a RESOLUTION VACATING AND ABANDONING SPUR TRACK EASEMENT WHEREAS, pursuant to the provisions of Article 5 (commencing at ~50430) of Chapter 2, Part 1, Division l, Title 5, of the Government Code, the Council of the City of Redwood City has, by its Resolution No. 5779, adopted September l6, 1968, declared its intention to vacate a portion of a spur track easement, which easement is designated as such on that map entitled "Redwood Industrial Tract No.2," recorded in Book 35 of Maps at pages 3 - 6, in the office of the Recorder of San Mateo County, California, on April 30, 1952: and WHEREAS, pursuant to said provisions, notice of intention to vacate and abandon the above mentioned portion of the spur track easement has been published and posted: and WHEREAS, a public hearing has been held and evidence taken: NOW, THEREFORE: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. The Council of the City of Redwood City finds (a) that the hereinafter described spur track easement has not been used for spur track purposes since the date of its designation as such and (b) that the easement is unnecessary for present or prospective public use. 2. The above mentioned spur track easement which is to be vacated is described as follows: All of that 15.00 foot spur track easement in Lot 3 and Lot 6, Block 5, as said easement, lot, and block are shown on that map entitled "Redwood Industrial Tract No.2," recorded April 30, 1952, in the office of the Recorder of San Mateo County, California, in Volume 35 of Maps, at pages 3, 4, 5 and 6.
