<br />\., <br /> <br />. <br /> <br />. <br /> <br />DES:yc:9/24/68 <br /> <br />REE.OLUT1.0N <br /> <br />N O. ~Pt)3 <br /> <br />O r.~ !I"\ U\I <br />i ~ 1 " i n, L\ L <br />"-'<11'\11 <br /> <br />ell 2,1 '''.a <br /> <br />RESOLUTION VACATING AND ABANDONING SPUR TRACK EASEMENT <br /> <br />WHEREAS, pursuant to the provisions of Article 5 (commencing <br /> <br />at ~50430) of Chapter 2, Part 1, Division l, Title 5, of the <br /> <br />Government Code, the Council of the City of Redwood City has, <br /> <br />by its Resolution No. 5779, adopted September l6, 1968, declared <br /> <br />its intention to vacate a portion of a spur track easement, which <br /> <br />easement is designated as such on that map entitled "Redwood <br /> <br />Industrial Tract No.2," recorded in Book 35 of Maps at <br /> <br />pages 3 - 6, in the office of the Recorder of San Mateo County, <br /> <br />California, on April 30, 1952: and <br /> <br />WHEREAS, pursuant to said provisions, notice of intention <br /> <br />to vacate and abandon the above mentioned portion of the spur <br /> <br />track easement has been published and posted: and <br /> <br />WHEREAS, a public hearing has been held and evidence taken: <br /> <br />NOW, THEREFORE: <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. The Council of the City of Redwood City finds (a) that <br /> <br />the hereinafter described spur track easement has not been used <br /> <br />for spur track purposes since the date of its designation as <br /> <br />such and (b) that the easement is unnecessary for present or <br /> <br />prospective public use. <br /> <br />2. The above mentioned spur track easement which is to be <br /> <br />vacated is described as follows: <br /> <br />All of that 15.00 foot spur track easement in <br />Lot 3 and Lot 6, Block 5, as said easement, lot, <br />and block are shown on that map entitled "Redwood <br />Industrial Tract No.2," recorded April 30, 1952, <br />in the office of the Recorder of San Mateo County, <br />California, in Volume 35 of Maps, at pages 3, 4, <br />5 and 6. <br />
