P-1353 <br /> <br /> RESOLUTION APPROVING SUBLEASE AGREEMENT TO KAISER <br /> CEMENT AND GYPSUM COMPANY LEASE AGREEMENT <br /> <br /> WHEREAS, Section 32 of that certain Lease agreement <br /> "Lease" dated October 1, 1976 by and between the City of <br /> Redwood City acting by and through its Board of Port <br /> Commissioners ("Lessor") and Kaiser Cement and Gypsum Company <br /> ("Lessee"), provides for the sublease of the premises subject to <br /> the consent of the City of Redwood City ' s Board of Port <br /> Commissioners; and <br /> <br /> WHEREAS, Leasee has prepared a Sublease agreement for review <br />by Lessor and, approval from the Board of Port Commission, and <br />as to form by its attorney; and <br /> <br /> WHEREAS, notwithstanding the approval of the sublease, the <br />Lease between Lessee and Lessor is still valid; an'd <br /> <br /> WHEREAS, Lessee is still responsible to fulfill the terms <br />and conditions of that certain Lease; and <br /> <br /> WHEREAS, all payments and revenues due Lessor, pursuant to <br />that certain Lease agreement, is to be made by Lessee to Lessor; <br />and <br /> <br /> WHEREAS, all tariff charges incurred by Lessee and the <br />Subleasee pursuant to Article 4 of that certain Lease is to be <br />paid to Lessor; and <br /> <br /> WHEREAS, all such tariff charges shall be assessed on cargo <br />unloaded from a land car~ier on the same basis as cargo unloaded <br />from an ocean carrier; <br /> <br /> NOW, THEREFORE; <br /> <br /> <br />
