<br />f <br /> <br />. <br /> <br />~ <br /> <br />RESOLUTION NO. 570'1 <br /> <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY <br /> <br />BEL AIR WAY IMPROVEMENTS <br /> <br />WHEREAS, on April 22, 1968, the Council of the City of <br />Redwood City adopted a resolution of preliminary determination <br />to make public improvements in the City of Redwood City, being <br />Resolution No. 5674 of said Council, to construct cer- <br />tain public improvements more particularly described therein, <br />and did fix therein this date as the time and place when and <br />where any and all persons interested may appear and show cause, <br />if any they have, why the City Council should not find and de- <br />termine that the public convenience and necessity require the <br />.improvements described and referred to in said resolution with- <br />out compliance with the Special Assessment, Investigation, Lim- <br />itation and Majority Protest Act of 1931; and <br /> <br />WHEREAS, notice of the adoption of said resolution and of <br />said time and place of hearing was given by the City Clerk by <br />publication and posting for the time and in the manner provided <br />in said resolution and Article II of Chapter 18 of the Redwood <br />City Code, as appears from the affidavits on file with the City <br />Clerk; and <br /> <br />WHEREAS, no persons objecting to the undertaking of said pro- <br />ceedings without first complying with the provisions of said <br />Special Assessment, Investigation, Limitation and Majority Protest <br />Act of 1931 have filed written objections thereto with the City <br />Clerk at or before the time fixed for this hearing by persons in- <br />terested, owning or having an interest in real property within <br />the proposed assessment district, bearing their signatures, a <br />description of their property, and a statement of the nature of <br />their interest therein; and <br /> <br />WHEREAS, all persons have been given an opportunity to be and <br />were fully heard, and said Council has duly considered any and all <br />objections and protests made, and the said proposed improvements <br />and the public convenienc~ and necessity for making the same; <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of <br />Redwood City as follows: <br /> <br />1. That the public convenience and necessity require the <br />improvements described in said Resolution No. 567~_.____. <br /> <br />2. That any and all objections and protests made pursuant <br />to said resolution be, and the same are, hereby over- <br />ruled and denied. <br /> <br />3. That the improvements described in said resolution' , <br />be made under and pursuant to the provisions of the <br />Improvement Act of 1911 as embodied in the Streets <br />and Highways Code of the State of California, as <br />amended, and that the Special Assessment, Investiga- <br />tion, Limitation and Majority Protest Act of 1931 <br />shall not apply to said proceedings. <br /> <br />*** <br /> <br />*** <br /> <br />*** <br />
