RESOLUTION N0. 334_ <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY <br />PIEDMONT WAY IMPROVEMENTS <br />WHEREAS, on March 27, 1961, the Council of the City of Redwood <br />City adopted a resolution of preliminary determination to make public <br />improvements in the City of Redwood City, being Resolution No. 3341 <br />of said Council, to construct certain public improvements more par- <br />ticularly described therein, and did fix therein this date as the <br />time and place when and where any and all persons interested may ap- <br />pear and show cause, if any they have, why the City Council should <br />not find and determine that the public convenience and necessity -Le- <br />quire the improvements described and referred to in said resolution <br />without compliance with the Special Assessment, Investigation, Limi- <br />tation and Majority Protest Act of 1931; and <br />WHEREAS notice of the adoption <br />time and place of hearing was given <br />tion and posting for the time and i n <br />resolution and Ordinance No. 515 of <br />appears from the affidavits on file <br />of said resolution and of said <br />by the City Clerk by publica- <br />the manner provided in said <br />the City of Redwood City, as <br />with the City Clerk; and <br />WHEREAS no persons objecting to the undertaking of said pro- <br />ceedings without first complying with the provisions of said <br />Special Assessment, Investigation, Limitation, and Majority Protest <br />Act of 1931 have filed written objections thereto with the City <br />Clerk at or before the time fixed for this hearing by persons <br />interested, owning or having an interest in real property within <br />the proposed assessment district, bearing their signatures, a <br />description of their property, and a statement of the nature of <br />their interest therein; and <br />WHEREAS all persons have been given an opportunity to be and <br />were fully heard, and said Council has duly considered any and all <br />objections and protests made, and the said proposed improvements <br />and the public convenience and necessity for making the same; <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY the Council of Red- <br />wood City, as follows: <br />1. That public convenience and necessity require the im- <br />provements described in said Resolution No. 3341, <br />2. That any and all objections and protests made pursuant <br />to said resolution be, and the same are, hereby overruled <br />and denied. <br />3. That the improvements described in said resolution be <br />made under and pursuant to the provisions of the Improvement <br />Act of 1911 as embodied in the Streets and Highways Code of <br />the State of California, as amended, and that the Special <br />Assessment, Investigation, Limitation and Majority Protest <br />Act of 1931 shall not apply to said proceedings. <br />
