<br />~:. .' <br />I ~ _ .~Y <br />i D1' <br /> <br />. <br /> <br />. <br /> <br />REG:yc:6/l0/60 <br /> <br />RES 0 L UTI 0 N <br />---------- <br /> <br />N o. 3108 <br /> <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY FINDING <br />AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE <br />THE ACQUISITION AND CONSTRUCTION BY THE CITY OF REDWOOD CITY <br />OF A PUBLIC IMPROVEMENT, NAMELY A PUBLIC STREET, IN AND UPON <br />THAT CERTAIN REAL PROPERTY HEREIN DESCRIBED; THAT THE ACQUISITION <br />OF A RIGHT OF WAY AND EASEMENTS IN SAID REAL PROPERTY HEREIN <br />DESCRIBED IS NECESSARY FOR SAID PUBLIC IMPROVEMENT; AUTHORIZING <br />THE CITY ATTORNEY TO BRING AN ACTION IN EMINENT DOMAIN TO <br />ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC IMPROVEMENT AND TO <br />APPLY FOR AN ORDER OF IMMEDIATE POSSESSION OF SAID REAL PROPERTY; <br />AND, AUTHORIZING AND DIRECTING THE CITY MANAGER TO DEPOSIT MONEY <br />IN COURT FOR IMMEDIATE POSSESSION OF SAID REAL PROPERTY <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> <br />AS FOLLOWS ~ <br /> <br />That it hereby finds and determines and declares: <br /> <br />That the public interest and necessity require the acquisition <br />and construction by the City of Redwood City of a public improve- <br /> <br />ment, namely, a public street, in and upon that certain real property <br /> <br />hereinafter described; <br /> <br />That the acquisition by the City of Redwood City of a right of <br /> <br />way and easements in and upon that certain real property hereinafter <br /> <br />described is necessary for said public improvement; <br /> <br />~nat said public improvement is the use to which said real prop- <br /> <br />ert~r is to be applied, and that said use is a public use authorized <br /> <br />by law; <br /> <br />That said public improvement is planned and located in the <br />manner 1~hich will be most compatible with the greatest public good <br /> <br />and the least private injury; <br /> <br />AND.7 BE IT FURTHER RESOLVED: <br /> <br />That the City of Redwood City acquire said right of way and <br /> <br />easements in Qnd upon said real property, for said public improve- <br /> <br />ment, by an action in eminent domain in accordance with the provisions <br /> <br />of the Charter of the City of Redwood City, the provisions of <br />Article I, Sec~~n 14, of the Constitution of the State of California, <br /> <br />and the provisions of t'he Code of Civil Procedure of the State of <br /> <br />California relating to eminent domain, said real property being all <br />that real ~roperty situate in the City of Redwood City, County of San <br /> <br />Mateo, State of California, more particularly described as follows: <br /> <br />" <br /> <br />~ <br />
