REG:ek :8/22/60 -7 <br /> lop <br /> RE SOLUT I ON NO. 3189 <br /> RESOLUTION AUTHORIZING AND PROVIDING FOR THE DEFENSE <br /> OF PROPERTY DAMAGE SUIT` RESULTING FROM STREET IMPROVE- <br /> MENT PROCFFT)INGS; AND, APPROPRIATING $800 IN CONNECTION <br /> THEREWITH <br /> WHEREAS, subsequent to the improvement of Hilltop Drive in <br /> the City of Redwood City in 1956, suit was commenced on behalf <br /> of two property owners for property damage; and, <br /> WHEREAS, the City has been unable to obtain an equitable <br /> settlement of the suit and it appears that the case will be set <br /> for trial in the immediate future; and, <br /> WHEREAS, in connection with the trial and its preparation <br /> it is advisable that the original attorney, Chester W. Lebsack, Esq., <br /> be associated with the City Attorney for purposes of assisting in <br /> the taking of depositions and otherwise assisting in the trial of <br /> the factual matters of the case; and, <br /> WHEREAS, it is estimated that the costs of preparation, <br /> depositions, and a two day trial will be approximately eight <br /> hundred dollars ($800); <br /> NOW, THEREFORE; <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> AS FOLLOWS: <br /> 1. The City Attorney is hereby authorized to associate <br /> Mr. Chester W. Lebsack to assist in the preparation and trial of <br /> the case of McCune and Sawyer vs. City of Redwood City. <br /> 2. The sum of eight hundred dollars ($800) is hereby <br /> appropriated from the unbudgeted unappropriated balance of the <br /> General Fund to the City Attorney Supplies and Services Account <br /> for expenditure during the fiscal year July 1, 1960 -June 30, 1961, <br /> for the purposes of preparation and trial, including attorney's <br /> fees for Mr. Lebsack, of the case of McCune and Sawyer vs. City <br /> of Redwood City. <br /> 3. All moneys appropriated herein are in addition to all <br /> sums heretofore appropriated for expenditure during the fiscal <br /> year July 1, 1960 -June 30, 1961. <br /> * * * <br />
