01/10/2011 <br /> ORIGINAL <br /> RESOLUTION NO. 15078 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY ESTABLISHING SOLID WASTE COLLECTION <br /> RATES <br /> WHEREAS, pursuant to agreement with the South Bayside Waste <br /> Management Authority (SBWMA), a rate analysis has been conducted regarding <br /> solid waste collection rates in the City of Redwood City; and <br /> WHEREAS, upon the recommendation of said Authority, of which this City <br /> is a member agency, revisions to the rates of charge for said purposes have <br /> been proposed; and <br /> WHEREAS, pursuant to the provisions of Section 14.31 of the Municipal <br /> Code of the City of Redwood City, schedules of charges for such purposes shall <br /> be established by resolution of this Council; and <br /> WHEREAS, the City Council's action is not a "project" pursuant to CEQA <br /> Guidelines section 15378(b)(4) because the City is setting maximum rates for <br /> solid waste collection to be charged by Recology San Mateo County which are <br /> intended to fund on -going solid waste collection services, and as such, the action <br /> involves a funding mechanism or fiscal activity within the meaning of the CEQA <br /> Guidelines; and <br /> WHEREAS, notices were sent as required by Government Code Section <br /> 53755, a hearing was held in accordance with the requirements of Article XIII D, <br /> Section 6 of the California Constitution (Proposition 218), no majority protest <br /> exists, and the proposed rate increase complies with the limitations for use in <br /> Article XIII D, Section 6(b). <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> 1. The schedule of charges for solid waste collection services in the City <br /> of Redwood City is hereby established as set forth in Exhibit "A," <br /> attached hereto and by this reference incorporated herein. <br /> 2.
